In such cases, surveyors play a pivotal role in clarifying the facts, facilitating resolution and supporting litigation processes. 

The Surveyor’s Role 

Surveyors are trained professionals who specialise in measuring, mapping, and analysing land and property features. Their expertise includes boundary demarcation, structural integrity assessments, property valuation and legislative knowledge such as the Landlord and Tenant Act. A surveyors technical knowledge plays a crucial role in establishing contested facts during disputes.

Surveyors compile their findings into detailed reports and plans, which help mediate disputes or serve as evidence in court. By providing clarity, surveyors help prevent escalation and foster amicable resolutions between neighbours or stakeholders. 

Surveyors in Litigation 

When disputes progress to litigation, surveyors may be called upon to act in several capacities: 

  • Expert Witnesses: Surveyors provide technical evidence to assist the court in understanding complex property issues. Their overriding duty is to the court, not the party instructing them.
  • Advisers and Mediators: In pre-litigation stages, surveyors may advise clients on the strength of their claims or act as neutral mediators to facilitate settlement. 
  • Arbitrators: In some cases, surveyors are appointed as arbitrators to make binding decisions based on their expertise in accordance with the Arbitration Act 1996. 

Their reports must meet rigorous standards, and any breach of duty can lead to legal liability. For example negligence in valuation or misrepresentation. However, when acting as expert witnesses, surveyors have a degree of immunity from civil proceedings, provided their conduct aligns with professional and judicial expectations.

Professional Standards and Accountability 

Surveyors must follow the codes of conduct set by professional bodies such as the Royal Institution of Chartered Surveyors (RICS). These standards ensure that surveyors maintain integrity, objectivity, and competence in all aspects of their work. Breaches can result in disciplinary action, even if the surveyor was acting in a judicial capacity.

Their ability to provide accurate, unbiased, and legally sound assessments helps clarify contentious issues and contributes to fair outcomes.
